MINUTES OF THE WRAXALL & FAILAND PARISH COUNCIL MEETING

HELD AT FAILAND VILLAGE HALL 7.30PM 9 SEPTEMBER 2008.

 

PRESENT : Cllrs. Ambrose (Chairman), King (Vice Chairman) Law, Sage, Sheppard, Mrs Shaw, Thompson, Delmas & Smith.

 

APOLOGIES: Cllr. Mrs Moon, District Cllr Cook arrived at 7.47pm.

 

IN ATTENDANCE: District Cllrs. Roberts & Cook (from 7.47), Liaison Officer Sally Varley & PC Adam Clarke.

92                 MINUTES of the meeting held 12 August were agreed and signed after amendments to ‘Minutes of the meeting 8 July’ on page 1 and at 87 Extra Items – ‘INCIDENT by Battle Axes on B3130’.

 

93                 CRIME FIGURES : Eight this August compared to 18 for the same period last year.

3 Thefts from Motor Vehicles (1 Tyntesfield, 1 Sixty Acres, 1 Handbag at Wraxall Service Station).

2 Non dwelling burglaries. 1 theft after a party. 1 nuisance, 1 cannabis.

 

MEETING CLOSED 7.44PM for Dr Mike Amos to speak re.

 

LOCAL ACCESS FORUM – Last Sunday there were 31 horses past his door and cyclists too.  He felt that we should look at ‘Quiet Lanes’. Cycle route 334 uses Sandy and Failand lanes and riding establishments take children out by his farm.

He pointed out that GPS directs visitors to Tyntesfield through Failand.

He asked that when we are putting a programme together he would like us to consider making Oxhouse, Sandy & Common lanes into ‘Quiet Lanes’

Need to protect horses, cyclists and walkers etc. – white lines down the sides of lanes would give priority to them whilst they are within the verge and the lines.

He asked that we as PC support the Quiet Lanes with NSC.

 

He mentioned that Bristol is a ‘cycling city’.  At this point it was brought to the attention of all the Cllrs. that Bristol City Council did not advise the PC of the ‘Bristol’s Biggest Bike Ride’ earlier in the year.  This goes through Lower Failand.  Clerk to write to BCC asking that we are informed well before the event in future years.

94                 TYNTESFIELD

 

Ruth Gofton gave an update.

The is a Free Open Day on Saturday.

LB consents should take 8 weeks but NSC are taking between 2 – 6 weeks to register them.  D/Cllrs will speak to NSC regarding this time delay.

There will be Planning Applications being put in later on.  Miss Gofton gave her apologies for the October meeting.

 

95                 ISSUES

 

a)       PARISH BOUNDARIES ~ PETITION

Petitions have been sent to all dwellings in Wraxall & Failand.  Replies are either by post or may be placed in special collecting boxes around the villages.  D/Cllr. Cook will receive the petition at a press photo shoot in Wraxall on 19 September and then present it to FULL Council Meeting.

Concern was expressed that, if the boundary change were to be approved, it could mean a possibility of children from The Elms not being able to obtain a place in Wraxall School.  Cllr. Law will forward a letter to the Headmistress.

Thanks were expressed to Cllr. Law, Chairman of the Parish Boundary Review Committee, & to Brian Symonds & Tony Tavener, both Committee Members) for the work they had done to organise the petition.

 

b)       PARISH PLAN ~GRANTS ~ ANALYSIS

Update from Doug Macmillan (Chairman of the PP committee) was read to Cllrs.

He has applied to Quartet re. a grant to continue the work but there is a possible 6 week turn around.  Questionnaire responses are being put on a data base & should be available this week, for the student to work, on prior to the PP committee starting the interpretation and compilation of the initial conclusions.  Cllrs. felt that the grant applications should be invigorated.

 

c)       QUARRY – As residents are still concerned re. the Quarry the Clerk is to write again to NSC.

 

d)       BATTLE AXES – Public meeting today 3 – 7pm for residents to view the plans.  There were still 11 at the meeting at 7pm.  Thirty had been to the meeting.

 

96                 PLANNING & ENVIRONMENT

 

MEETING CLOSED 8.43PM

Ruth Gofton referred to the Planning Applications for the:-

Stable Block at Tyntesfield.

Re. Privacy – the window will be 1.6m high.

Re. Fire – Kitchen which is at the far end will be the highest risk.  There will be smoke detectors in the bedrooms and 1 hour fire resistant steel studded doors.

There will be no parking at the site.  Cars will be left in the Car Park.

                  Coach House at Tyntesfield

                  Again No parking on site

                  Kitchen will be hot and cold water only ~ no food preparation

                  It is not now necessary to have two doors between a kitchen and wc.

                  There will be fire resistant doors.

                  These two applications are referred to at a) & b) below and will be resubmitted.

 

Recommendations for applications a) to d) have already been forwarded to NSC to comply with time limits

 

a)      APPLICATION 08/P/1651/F – Change of use from flat to hostel accommodation for up to          

five residents with communal facilities for The National Trust, Inner Stable, The Stable

Block, Tyntesfield.

 

RECOMMENDATION ~ Councillors met with the three neighbours affected by the application.( All had received notice from NSC)

Councillors felt they could not support the application as presented for the following reasons;
- The layout of the accommodation is arranged so that the end room, the kitchen and lounge will impact on number 63 and 64 and their privacy. This we feel could be improved if this area was retained as a bedroom.
- The accommodation is accessed from only one staircase with the area of highest fire risk, kitchen, at the far end. The bedrooms are closest to the existing staircase. On this basis we are unsure of the requirements to have an additional staircase. However, should the kitchen be relocated to reduce the impact on 63 & 64 then we believe an additional staircase will be required.
- Vehicle Parking. The application form suggests it is contained in the Design & Access Statement, but no information is given in the DAS on the proposals for vehicle parking which we feel will impact and harm the character of the courtyard and elevations of the buildings.
- One of the neighbours is quite positive about the proposals, two are less so, as it will impact on their privacy. With which the Councillors concur.

For the foregoing reasons Councillors could NOT support the application as presented.

 

b)      APPLICATION 08/P/1654/F –  Change of use from coach house (part) into facilities for volunteers including rest area for The National Trust, The Coach House, Stable Yard, Tyntesfield, Wraxall

 

RECOMMENDATION - Councillors met with the three neighbours affected by the application.( All had received notice from NSC) Councillors felt they could not support the application as presented for the following reasons;

Councillors questioned whether this was the most appropriate location for the volunteers   

facilities as it is remote from the staffed visitor areas.

If well used it will be a noisy addition to a quite and peaceful area and impact on the             

privacy and enjoyment of the house and garden of Hannah More Lodge.

The site is presently used as a garage for the tractor and no reference is made as where

this will now be located.

The application form under Vehicle Parking suggests it is contained in the Design and Access Statement but no reference can be found for car parking proposals in the DAS. which we feel will impact and harm the character of the courtyard and elevations of the buildings.

Referring to design matters the councillors had concerns over two matters. - the proposals show a wc opening directly on to the kitchen which we believe is not an acceptable hygiene standard. There is a reference for the partition wall and sliding door but no reference as to it's appropriate fire resistance.

For the foregoing reasons the Councillors could NOT support the application as presented.

 

c)       APPLICATION 08/P/1746/F – Alteration and conversion of roof to living accommodation including  front and rear dormers for Mr & Mrs Powell, 14 Sixty Acres Close, Failand.

 

RECOMMENDATION - This appears to be the same as previously applied for on 07/P/2115/F, which was refused on the grounds that 'The proposed dormers to the front roof slope would have a detrimental impact on the character and appearance of the street scene, and as such would harm the visual amenities of the surrounding area contrary to Policy H/7 of the North Somerset Replacement Local Plan'. Councillors attending the property were told that 'others in the road got dormers back along and so they were trying it again'. Not sure to which they are referring but P/A's 07/0398 & 08/0444 both on No. 8 were both approved and both included dormers. Application 07/P/2211/F on No. 10 was passed. This included 3 dormers to the front and 3 to the rear. However a further P/A 08/P/1421/F, applied for in June 2008, was described as a revision to 07/2211 and did not include any dormers. It is felt that the current P/A is in the balance unless NSC has had a change of policy over dormers in this particular road.

Within the back garden of No. 14 is a partly built garage for which permission has not been sought. The applicants say that it is 'Permitted development' but does the fact that it is 2 storey allow it to be permitted development?

 

d)      APPLICATION 08/P/1750/T2 – Lime x 1 Fell, Copper Beech x 1 Fell at Failand Court Oxhouse Lane Failand. (5 day notice)   Letter received from TPO Dept. stating that     both trees have disease and are liable to wind tumble.

 

e)       APPLICATION 08/P/1757/F – Erection of double garage following demolition of existing single garage for Mr P Burchill, Sillerton, Old Chelsea Lane, Failand.

 

RECOMMENDATION – Approve.

 

f)         APPLICATION 08/P/1780/F – Replacement of existing riding stables for Mr P Fox, Marshfield House, Horse Race Lane Lower Failand

 

Message to NSC – Can you please advise the arrangements for foul water disposal and also where foul straw will be stored until disposal.

 

 

g)       APPLICATION 08/P/1793/F – Erection of two storey side extension and an existing single storey rear extension following the demolition of existing playroom for Mr Brown, St. Johns House, Bristol Road, Wraxall.

 

RECOMMENDATION – Whilst Councillors have sympathy with this application it is in the Green Belt and the Conservation Officer has advised that it is more than likely in the curtilage of Tyntesfield Listed Building.  We are unable to support it at present as more information is needed and, if necessary, a Listed Building Application.

 

h)       APPLICATION 08/P/1796/F – Demolition of existing derelict dwelling and erection of 2 no. dwellings for Mr P Jones at 45, Clevedon Road, Failand.

 

RECOMMENDATION – Support.

 

i)         APPLICATION 08/P/1814/F – Erection of a tiger house and associated fencing for Noah's Ark Zoo Farm, Moat House Farm, Clevedon Road, Wraxall.

 

At present we have insufficient details regarding Public Safety & Public Footpaths.

The PROW currently passes through the centre of the Zoo Farm not having been moved to one side, as the owner said he would, but no diversion requests have been received.

The PROW should be moved before any large project is undertaken.

 

j)        APPEAL - ROSE COTTAGE RE08/P/0203/F – DISMISSED.

 

EXTRA ITEMS

TPO’s.  As there has been Auction notices for Tall Trees, 7 Weston Road, Failand Cllrs. felt that the Tree Officer should be asked to visit and raise TPO’s on any trees worthy of keeping as they would appear to be in imminent danger.

 

SEAT which had been outside the Community Room has still not been placed in the village.  Cllrs. felt that it was acceptable to be placed at the side of the Cross Tree ~ against the wall on the closed slip road side. 

 

k)      Clerk reported on decisions made by North Somerset Council on planning applications previously considered by this Council.
