MINUTES OF THE WRAXALL & FAILAND PARISH COUNCIL MEETING

HELD 7.30PM 8 SEPTEMBER 2009 IN FAILAND VILLAGE HALL.

 

PRESENT ~ Cllrs. Ambrose (Chairman), Thompson (Vice Chairman), King, Mrs Shaw, Pitt & Sage.

 

IN ATTENDANCE ~ D/Cllr. Roberts, Liaison Officer Sally Varley & Clerk Freda Shattock.

DECLARATIONS OF INTEREST ~ Nil

 

233              MINUTES of the meeting held 11 August 2009 were agreed and signed.

 

234              CRIME FIGURES ~ Although PC Clarke 2707 arrived at the meeting he was called away before it started.  He left the crime figures.  There were 5 crimes since the last meeting. Other criminal damage to a dwelling £5000, Breach of non molestation order, Making off without payment, Theft from a Motor Vehicle X 2.

 

235              ISSUES

 

a)       WESTON ROAD PROPOSAL  ~  The Planning Application has not yet been registered – More information has been requested from the applicants.  Once registered there will be 16 weeks in which to comment.  If no decision has been reached after that time the applicant can take it to Appeal for Non-determination.

The Inspector can then either make a decision or MAY refer it to the Secretary of State.  Cllr. King felt that , if the application is not determined in time, the applicant could claim it.

It is a Legal as much as technical process and will rely on what has happened in respect of the RSS & Core Strategy.

NSC are not sure if they can remove land from the Green Belt. They are asking for legal advice.  Agricultural land is no longer an argument against removing land from GB.  Cllr. Ambrose commented that there is not enough food producing land currently to provide for the population.

It was felt that Highways & Planning could attend our meetings.

The Environmental report MAY have to be purchased.

 

As the Chairman is away for the next two weeks he asked Cllr. Thompson (Vice) to call an EGM if the application is received whilst he is away, to check it over and see if we need anything extra.

 

The Working Group felt that the £40,000 felt necessary to consult legal advice could not be raised at their public meeting.  Cllr. Ambrose suggested Amanda Sutherland, who is a local solicitor and town planner, could be approached for advice. Non of us are competent to consider the huge P/A.

Cllr. Cave of Long Ashton wanted to talk re. Legal Advice.

                  Our comments will have material consideration.

                  If we pre-determined the outcome our vote would not be counted.

 

It was felt that we should also be commenting on the Planning Applications re. Ashton Vale and BIA.

 

 

 

 

 

b)       REPORTS FROM IMPLEMENTATION COMMITTEES

 

PROW ~  Report from Hugh Pratt, Chairman – Members of the committee represented different stakeholders such as landowners, leisure groups, councillors and local residents. He asks that the PC consider:-

1.       The crossing of the B3130 to the East of Gable Farm.

2.       The principle to carry out maintenance and improvements. (A feasibility study would then commence).

Councillors supported, in principle, the creation of a new North/South permissive Bridle Way across Tyntesfield estate to join an existing Bridleway south of B3130but want to see the details.  They were concerned that it may not stay as a route.

In respect of the PC carrying out maintenance – the PC are minded to receive proper and full presentation of the proposals.

The committee Chairman has scanned the 1950 map to his computer.

           

WRAXALL VILLAGE ~ Peterjohn Smyth has held a meeting in the Old Rectory grounds when 12 – 15 people attended and another meeting at the Battle Axes when 30 people attended.

 

WESTON ROAD (covered above at 235a)

 

ROAD SAFETY ~ The committee decided to leave the link road, through the valley, for now.  They are to monitor the speed through the village, getting ’concrete’ information for Highways & Police.

Cllr, Pitt me4ntioned a mirror at the top of the Grove.  Highways are always concerned re. mirrors.  They feel they are not a safety means.                                

c)       COMMUNITY EMERGENCY PLANS ~ Failand meeting was held on 27 August.  Cllr. Law, who is looking at Emergency Plans in Wraxall, has sent details of a lot of items.

Amateur Radio was mentioned and Peter Wharton has agreed to come on board.  Cllrs. mentioned knowledge of vulnerable residents.  This would only be on an ‘ad hoc’ basis.  GP’s would not be able to help with this because of Data Protection.  Cllr. Sage likened it to WW!! Wardens.

      

d)       BATTLE AXES UPDATE ~ English Rural Housing Assn. are talking to the Architects re. Affordable Housing.  The Airport parking within the Car Park will soon stop as the person funning that is moving to premises in Portishead.

The Restaurant & Bar manager feels that things are ‘looking up’.  He does not know Mrs Patel’s plans/

 

236              PLANNING & ENVIRONMENT

a)       APPLICATION 09/P/1244/LB – Internal alterations to include installation of internal door and panelling to Sunday School Building (Revision to 07/P/2318/LB for erection of single storey extension to west elevation and extension to east following demolition of existing lean-to) for PCC All Saints’, Wraxall, Cross Tree Centre.

 

RECOMMENDATION - SUPPORT

 

b)       APPLICATION 09/P/1254/F – Erection of side attached garage/workshop, addition of bay windows to front elevation and a glazed porch for K Marchant, Valley View, West Hill, Clevedon Road, Wraxall.

 

RECOMMENDATION – No objection providing the application does not contravene green belt legislation.

 

c)       APPLICATION 09/P/1291/LDE – EASTON IN GORDANO APPLICATION – INFORMATION ONLY

Use of granny annex under 96/0431 dated 8.3.96 as a self contained residential unit for Mr & Mrs D Jones, The Walnuts, Common Lane, Easton in Gordano.

 

The P/A has been sent to us for Information Only but I would like to make the following comments:-

One of the conditions of the Granting of 96/0431 states ‘Does NOT permit the granny annex to become a separate dwelling’

In view of the condition Councillors feel that the current P/A 09/P/1291/LDE should be REFUSED.

I understand that E-I-Gordano are requesting a site visit.  If there is such a visit may we please be invited.

 

d)       APPLICATION 09/P/1298/LB – Conservation and repair of Large Gothic Seat and Vases with security fixings and replacement carved tracery panels for National Trust, Broad Walk, Tyntesfield.

 

RECOMMENDATION – Support.

 

e)       APPLICATION 09/P/1332/F – Erection of a conservatory to south elevation for Mr & Mrs HA Calder, Alto Mira, West Hill, Wraxall.

 

RECOMMENDATION – There was previously an approved P/A in 2007 for conversion of garage to bedrooms.  If that and the present proposal are not considered more that the allowed addition then we have no problem. SUPPORT.

 

f)         APPLICATION 09/P/1358/TPO – 1 x Walnut – Crown reduce by 30% for Mr C Ellis, 47a Weston Road, Failand

 

RECOMMENDATION – Support.

 

g)       APPLICATION 09/P/1364/F – MULTIPLE PARISH WITH NAILSEA –

Renew planning permission for 3 portacabins, currently on site, for the introduction of 6 new portacabins & for a new concrete hardstanding storage area for Vetcogray Controls Ltd, High Street, Nailsea.

 

RECOMMENDATION – Councillors were concerned re. any proposed lighting as we have had previous complaints re. floodlighting being angled so that it shone into houses up Tower House Lane.  The company were very good about that and corrected it the day they were informed.  So, if there is to be any lighting could it please be unobtrusive.  Support.

 

h)       APPLICATION 09/P/1376/TPO – 3 x Turkey Oak – 25% crown reduction & 3m crown lift for Mr M Thyer, 17 & 19, Bowden Way, Failand.

 

RECOMMENDATION – Support

 

i)         APPLICATION 09/P/1380/F &

j)         APPLICATION 09/P/1381/LB – Erection of wood pellet fuel silo within fenced enclosure and installation of biomass boiler system within existing barn/bat house south-east of saw mill with new flue and connected to Tyntesfield House (grade 1 Listed) by pipe route to include ducted road crossing for National Trust, Tyntesfield House & Saw Mill Yard Barn, Tyntesfield.

 

RECOMMENDATION – A small point is the appearance of the stainless steel flue. Which would benefit from a coat of dark paint to reduce its visual impact on the building.

We note there is no details as to the heating pipes running in the trench, other than they are insulated.  Although not a planning matter, we would encourage consideration of pre-insulated underground pipe work with high quality workmanship at joints with appropriate closures to contain the insulation and minimise ingress of moisture which will cause corrosion and pipe failure in a very short time scale.  SUPPORT.

 

k)       APPLICATION 09/P/1384/LB – Repairs to include removal of cast iron flue, replacement of roof tiles, repair stonework, walls and joinery, reinstatement of finial, door, glazing and seating and internal repairs for National Trust, Summer House, Tyntesfield

 

RECOMMENDATION – Fully SUPPORT the repairs bringing a building in disrepair, into use.

 

l)         APPLICATION 09/P/1143/F – Letter from Lee Bowering re Belmont House

PC Views required by 14 September.

 

REPLY – Dear Mr Bowering,  I refer to your letter of 24 August 2009 which was              

sent on to all the W&F Councillors.

At the Parish Council meeting last evening the   following comments were made:- We understand that access and egress to and from the Estate is to be from the B3139 not the Lodge on Belmont Hill 

Re Section 106 Agreement – They felt that because of the large numbers turning into the Estate for Horse Trials etc. a Section 106 agreement could be used to install traffic lights or a roundabout on the B3130.  There have been hold ups during previous events and it was felt that traffic lights or a roundabout could reduce the inconvenience to those using that road but not going to the event.

In our Parish Plan is ‘a vision for the future’ which states ‘ A parish in which there are businesses that are in harmony with the rural nature of the area and in which residents can find local employment’.  Councillors felt that the proposals in the P/A 09/P/1143/F met both of these points.

With regard to the floodlighting for the menage/arena; this should be restricted to a reasonable time and should be diffused so as not to give light pollution to the surrounding area.

APPLICATION 09/P/1400/LB & 09/P/1401/F – Reposition new doorway to south elevation of Cross Tree Centre, revision to 07/P/2318/LB for erection of single storey extension to west elevation and extension to east following demolition of existing lead-to for PCC All Saint’s Church, Wraxall.

m)     Clerk reported on decisions made by NS Council on Planning Applications previously considered by this Parish Council.

a)       TEMPORARY PROHIBITION OF USE BY VEHICLES

Clapton Lane & Naish Hill, Clapton in Gordano for drainage & carriageway surfacing – 21 September anticipated for 5 days.

Clapton Lane from Clevedon Lane to Naish Hill.  Naish Hill – whole length.

a)       CIRCULAR WALK – This was generally thought to be good.  Cllr King felt that crossing the B3128 & B3139 was dangerous.

 

 

239              MEETINGS

 

a)       ANNUAL SEVERN ESTUARY FORUM – 11 SEPTEMBER IN GUILDHALL, GLOUCESTER - £30 for the day - if a member of the Forum (sponsorship available). NOTED.

 

b)       NORTH SOMERSET LOCAL STANDARDS CONFERENCE – IMPROVING STANDARDS – morning of Friday 27 November OR morning of Friday 4 December. Cllrs. Thompson & Law will attend.

INVASIVE WEED SPECIES – HIMALAYAN BALSAM & JAPANESE KNOTWEED

Cllrs identified several places where the two named weeds are present.

NSC to be asked for their policy regarding these on verges for which thet are responsible.

ADOPTION OF RED PHONE BOXES – Several want the boxes in Failand to stay.  One individual wants to purchase one outright as he wishes to be buried in it.  Letter to NSC stating that we are interested in adopting.  Another letter to the individual explaining that boxes cannot be moved from their present site.
