MINUTES OF THE WRAXALL & FAILAND PARISH COUNCIL MEETING HELD AT FAILAND VILLAGE HALL 7.30PM 13 MAY 2008
PRESENT – Cllrs. Sage, Delmas, Thompson, Law, Smith, Sheppard. Mrs Shaw, Ambrose & Pitt.
IN ATTENDANCE – District Cllr. Roberts, Liaison Officer Sally Varley & Clerk
PUBLIC – Dr Mike Amos.
As there were no nominations for the post of Chairman, Cllr. Ambrose said that he would stand again, seconded by Cllr. Sheppard. Voting was 8-1 in favour.
Cllr. Ambrose then signed a ‘Declaration of Acceptance of Office’. He proposed Cllr. King as his Vice Chairman, seconded by Cllr. Mrs Shaw. Voting all in favour.
The Chairman then took Apologies and Declarations of Interest in the items below.

e) APPLICATION 08/P/0843/F –Removal of agricultural occupancy condition no. 3
from approval 1255/85 Mr R Walker, New Holm Farm, Lower Failand.

DR Mike Amos addressed the meeting. An agricultural tie is put on a property to stop just what is happening at New Holm Farm. The property is being advertised at £325,000. A property with an Agricultural Tie should be advertised at between 40 – 60% of the market value. In this case between £165,000 – £170,000. Many young persons working in agriculture would like to have such a property at the ‘agricultural’ price being unable to pay the market rate on low agricultural wages. He felt that we should contact the Agricultural Dwelling House Commission,
He mentioned that it had been built across a Right of Way and we had a duty to report this.
Cllr. Ambrose said that it looks to be advertised as ‘free of any tie’
Dr Amos commented that Holm Farm is in Band E whereas his own tied property is Band C

Cllr. Sage asked if farmers were notified and if it is realistically priced

Dr Amos explained that as the present occupier was not working in agriculture the property was illegally let at present.

After a discussion the proposal was to recommend refusal. Voting – All in favour.
c) PLANNING TOGETHER WORKSHOPS
As Cllr. Ambrose had only been able to attend 1 of the meetings and Dr Amos had attended all Cllr. Ambrose asked Dr Amos, who is Chair of the Local Access Forum, to report.

Dr Amos reported on interesting meetings although they were dominated by people with pecuniary interests – developers.

MEETING THEN REVERTED TO THE ORDER IN THE AGENDA.
46 MINUTES – The minutes of the PC meeting held 8 April 2008 & the APM held 22 April 2008 were agreed and signed.
47 CRIME FIGURES – PC Adam Clarke had sent the following figures:-
Harassment 1, Criminal Damage 2, Theft 4 (3 of which were Budgens), Sexual Offences 1. A total of 8 offences compared with 13 for April 2007.
In answer to a comment by Dr. Amos that The National Trust did not keep ‘Affordable Housing’’, unlike Lord Wraxall, Miss Gofton explained that the Charity Commission would ask why, if they did not charge full rents. They have to be seen to be making the most of their assets. The Trust HAS only 6 housing stock – a small % compared to Lord Wraxall.
Several projects are underway but they hope the house to remain open whilst they are on going.
Forthcoming events include Father’s Day. Anyone visiting Tyntesfield by means of ‘green transport’ gets free entry.

ISSUES
a) PARISH PLAN – The Questionnaire is about to be printed.
b) BOUNDARY SUB COMMITTEE – Query that we should go back to the ‘old boundaries’. Tony Tavener and Brian Symonds are interested in being on such a committee. Chairman asked Cllr. Law if he would Chair it. Agreed.
c) REVISED CODE OF CONDUCT DVD. This is offered by NSC on a £40 returnable deposit. Cllrs. agreed that this should be ordered.
d) CORPORATE GOVERNANCE SUB COMMITTEE – Again Tony Tavener and Brian Symonds were interested in forming such a committee. Chairman asked Cllr. Sheppard if he would Chair it. Agreed.
e) WHAT DO WE WISH TO DO RE. HISTORICAL UNRESOLVED ISSUES
It was agreed that a ‘running log’ should be kept. Cllrs. to ‘take on’ outstanding items.
f) FUNDS – The Parish Council did not meet the criteria of those on offer in this communication.
g) QUARRY – Clerk explained that in the ‘Somerset Parochial Documents’ at 25 March 1881 it stated that Highways were to ascertain that the conveyance of the ‘New Quarry’ given some time ago by Sir Grenville (Greville) Smyth Bart had been duly executed. As the Council (Highways) at the time would have been Somerset they were asked if they could look in their archives to see if they still held the Quarry or if they could tell us to whom they passed it.. They replied that they used to lease a Quarry in Wraxall from Tyntesfield Estate until SCC terminated the lease in 1973. Clerk to write again to The Executors of Lord Wraxall (Tyntesfield Estate).
a) PRE
DECISION AMENDMENT ON 08/P/0374/F – Erection of two storey front, side and rear
extensions and erection of first floor accommodation to include raising the
roof and 1 front dormer and 2 rear dormers for Mr A. Chapman 25 Clevedon Road, Failand –
AMENDMENT – Relocation of front extension to the north west side.
RECOMMENDATION – Comments
as before as the proposed addition is still more than 100% increase. However, the change of position to the side
away from the tree with TPO is preferable.
b)
APPLICATION 08/P/0728/O - Outline
planning for erection of 6 dwellings
following demolition of existing dwelling for R Palmer at Alberta Cottage,
Bristol Road, Wraxall.
RECOMMENDATION - Councillors considered this an over development of the site as
the proposed new building is substantially larger than the existing dwelling.
It will have considerable impact on the Green Belt and the character of the
area by virtue of its increased height and mass. It will also prejudice the
amenity of the occupiers of the old cottages on the opposite side of the road.
It would appear to be contrary to the local plan as it is a significant
development outside the four main towns. Cllrs .believe that the removal of the
open space and garden will harm the character of the surrounding area, all of
which we consider is contrary to
policy RD3. The proposed live/work units appear to be a mechanism to overcome
the restrictions imposed by policy RD3, with the work units being
insufficiently separate from the residential area to be considered totally
independent. We would like to point out that within 100m there exists
considerable available workspace which is currently vacant and has been for
some time. We would therefore question whether there is a requirement for
additional workspace. There appears to be disparity in the description of the
development between paragraphs 3 and 10 where they are described as
flats/maisonettes not live/work units. We would also raise safety concerns over
the access for the 11 planned vehicles onto an already busy road, adjacent to a
large service station and opposite a newly installed bus stop.
REFUSE.
c) APPLICATION
-08/P/0729/F - Erection of an extension at first floor level and raise height
of main roof to form a two storey dwelling for Mr & Mrs Channing, 7
Clevedon Road, Failand.
RECOMMENDATION - Cllrs. felt that there was no problem with this proposal
unless it increases the dwelling by more than the allowed amount.
d) APPLICATIOIN
08/P/0774/F - Erection of detached double garage for Mr & Mrs Kendall, 26a
Belmont Drive, Failand.
RECOMMENDATION - Cllrs. could see no problem. However we understand that there
is an objection from a neighbour - this has been intimated but we do not have a
copy of the letter.
e) APPLICATION 08/P/0843/F –Removal of agricultural occupancy condition no. 3 from approval 1255/85
This application was dealt with earlier in these minutes.
f) APPLICATION 08/P/0854/ADV – Display of 1 no. free standing vinyl sign (A), 1 no post mounted directional sign (2A) 3 no. internally illuminated wall mounted signs (B,C & K) and 3 no. wall mounted notices (E & F) for GE Oil & Gas Vetcogray, 2 High Street, Nailsea (but within our parish)
RECOMMENDATION – Approve.
g) APPLICATION 08/P/0903/F – Erection of first floor side extension above existing garage with spiral fire escape stairs to the rear for Mr Radnett 6 Bowden Way, Failand.
RECOMMEMDATION – Approve.
h) APPLICATION 08/P/0905/PDA(PRIOR DETERMINATION AGRICULTURAL) Erection of an agricultural storage building on Land off Charlton Drive, Wraxall for Mr MJ Pearce.
i) APPLICATION 08/P/0910/F – Erection of a first floor extension, with replacement roof and dormer windows and erection of a porch for Mr M Kennedy, Jubbs Court Farm, Failand Lane, Failand
RECOMMENDATION – No objection but with a condition that there is never to be a window allowed in the proposed new gable end shown in the bottom left drawing on plan 654:PL:1:04. We must point out that the end elevations have been transposed on the plans. The gable in which we specify 'no window' is the one on Jubbs Court side.
j) APPLICATION 08/P/0914/F – Erection of a 15m monopole wind turbine for electricity generation on land at Moat House Farm, Clevedon Road, Wraxall (Noah’s Ark Zoo Farm)
RECOMMENDATION – Approve.
k) APPLICATION 08/P/0915/LB – Installation of 2 no. CCTV security cameras with integral infrared lights and control equipment mounted beneath eaves on north west corner and inside main porch for The National Trust at Wraxall Lodge, Tyntesfield.
RECOMMENDATION - Approve.
l) APPLICATION 08/P/0918/F – Erection of a single storey rear extension for Mr N Smythe, Stileways, West Hill, Wraxall.
RECOMMENDATION – Approve.
m) APPLICATION 08/P/0920/LB – Insertion of ½ hour fire resistant screen and doors to first floor corridor and upgrading of 2 no. bedroom doors to the ½ four fire resistance for The National Trust at Tyntesfield
RECOMMENDATION - Approve
n) APPLICATION 08/P/0978/F – Erection of a dwelling and garage following the demolition of existing property, garages and outhouses for Mr A Franklin (Agent for Mr & Mrs Porter) Ridge House, Horse Race Lane, Failand.
RECOMMENDATION – Approve.
EXTRA ITEMS
APPLICATION 08/P/1003/F – Temporary erection of a Mongolian yurt in one quadrant of the walled kitchen garden to provide learning facilities for up to 40 children until the sawmill educational facility becomes available in March 2009 for The National Trust at Tyntesfield.
RECOMMENDATION – Approve.
APPLICATION 08/P/0801/F – INFO ONLY – Construction of a pedestrian footbridge over B3128, Clevedon Road, Failand for Bristol Grammar School, University Road, Bristol. (Long Ashton Application)
Whilst we realise that this has been sent to us for information only we make the
following comments:-
There is no support.
There is no merit.
There is no safety cage.
There must be a cheaper option.
It results in reduced car parking.
APPEAL – ROSE COTTAGE, BRISTOL ROAD, WRAXALL against refusal of 08/P/0203/F.
Letter sent in triplicate to Planning Inspectorate –
In our original recommendation we sent a report to North Somerset Council stating that, although the applicant calculated that the increase in floor area was 30% our Councillors calculated it as being more than 120%. North Somerset Council state that the increase would be 151% over and above the gross floor area of the original building.
We are still not against the proposal in principle but it is far too large and the size would need to be much reduced.
THERE IS TO BE A SITE VISIT IN REPECT OF THE APPEAL RE. GLB’S – Land near the Cricket Ground, Failand. May 28th. Cllrs. Sage, & Sheppard advised. Cllr. King to be advised when he returns from holiday.
o) The Clerk reported on decisions made by NSC on planning applications previously considered by this Council.
As it was already 10.00pm The Chairman
suggested that the rest of the meeting be held over until the June meeting.
Cllr. Mrs Shaw suggested that the
Accounts should be approved.
This was agreed and the meeting then
closed.
