MINUTES OF THE WRAXALL & FAILAND PARISH COUNCIL HELD AT

7.30PM 10 JUNE 2008 AT WRAXALL CEVA SCHOOL

 

PRESENT – Cllrs. Ambrose (Chairman), King (Vice Chairman), Pitt, Law, Thompson, Delmas, Mrs Shaw, Sheppard, Sage & Smith.

 

IN ATTENDANCE – District Cllr. Roberts, Liaison Officer Sally Varley. PCSO 8017 Thompson & Clerk.

 

APOLOGIES – District Cllr. Cook, Cllr. Mrs Moon, Ruth Gofton National Trust & PC Adam Clarke 2707.

PUBLIC – Nil.

 

DECLARATIONS OF INTEREST – Nil.

 

57         MINUTES – The Minutes of the meeting held 13 May 2008 were agreed and signed.

 

58         CRIME FIGURES – PCSO Thompson gave apologies for PC Adam Clarke and the crime figures for May – Criminal Damage 1, Theft from vehicle 1, Theft 3 inc. Lead from Cottage on Tyntesfield & Office broken into and items taken on Tyntesfield

            1 other, Total 6.

            Cllr. Mrs Shaw queried low loaders & 42 ton Quarry Lorries using Belmont Hill.

            PCSO will investigate.

 

59                 TYNTESFIELD  No report as Ruth Gofton was not at the meeting.

 

60                 ISSUES

a)       PARISH PLAN – Questionnaire to printers – back on track – meeting to finalise.

 

b)       BOUNDARY – Cllrs. Law & Ambrose, Tony Tavener & Brian Symonds met  to discuss terms of reference.

Nothing direct has been received from NTC.  However it is recorded in their February 2008 Minutes.

We would lose 300 of the 900 houses.  The school and Church may also be affected. Those left in Wraxall & Failand would see their Community Charge increase. The District Cllrs. may be affected. Cllr. Law felt that we should have a meeting with NSC to ascertain the legal process. As nothing had come to us from  NTC D/Cllr. Roberts felt that we should ‘hold fire’ at present.

Although most people on The Elms, which is the area mentioned in the minutes by NTC, do not want to live in Nailsea, Cllr. Ambrose said that NSC do not have to take the wishes of the people into account.

9 of the 10 Cllrs. present felt that we should leave this item for at least a month.

 

c)       CORPORATE GOVERNANCE COMMITTEE

Cllr. Sheppard met with Brian Symonds & Tony Tavener on 6 June at FCC.

A copy of the discussion will be sent to all Councillors & Clerk.

 

d)       QUARRY

Clerk to e-mail Morgan Baynham, head of Enforcement Dept. at NSC, asking who gave permission for the spoil to be put into the Quarry.  The determination certificate states at Condition 7 ‘No work shall be commenced until a method statement specifying removal and disposal of the material produced from the excavation works, have been submitted to and approved, in writing, by the Local Planning Authority.  The development shall be carried out in strict accordance with the approved method statement unless otherwise agreed in writing.’  This does not state that the spoil could be stored in the Quarry but Clerk was told by Planning Dept. that they had said that the spoil could be put into the Quarry until the site work was finished when it should then be removed.  (Rather strange that NSC should give, albeit temporary, permission to use the Quarry when they don’t own it).

60A      PLANNING & ENVIRONMENT

 

a)       PLANNING NOTIFICATIONS – E-MAIL FROM Richard Kent read to Cllrs.

 

OUR RECOMMENDATIONS FOR APPLICATIONS b – h & l had already been notified to NSC. – AS UNDER.

 

b)      APPLICATION 08/P/1003/F – Temporary erection of a mongolian yurt in one quadrant of the walled kitchen garden to provide learning facilities for up to 40 children until the sawmill educational facility becomes available in March 2009 for The National Trust at Tyntesfield.

 

RECOMMENDATION – Approve.

 

c)       APPLICATION 08/P/1027/F – Erection of a single storey production building with link to existing industrial building for Vetco Gray Controls Ltd, 2 High Street, Nailsea.

 

RECOMMENDATION – No objection.  However, no reduction in tree height should e undertaken.

 

d)      APPLICATION 08/P/1032/F – Erection of a rear conservatory, front porch, single and 2 storey side extension following demolition of existing garage and kitchen extension.  Insertion of 4 no. dormers to the front elevation and 1 no. dormer extension to the rear for Mr W Pearce, 22 Flax Bourton Road, Failand .

 

RECOMMENDATION – Approve.

 

e)       APPLICATION 08/P/0801/F - INFO ONLY - Construction of a pedestrian footbridge over B3128, Clevedon Road, Failand for Bristol Grammar School, University Road, Bristol. (LONG ASHTON APPLICATION).

Whilst we realise that this has been sent to us for information only we make the following comments:-

There is no support.  There is no merit. There is no safety cage.  There must be a cheaper option.

It results in reduced car parking.

 

f)        APPLICATION 06/P/1068/F – INFORMATION ONLY – LONG ASHTON P/A

Erection of a curving timber wall (max 9m high) to create a new façade to hotel and country club with erection of 2-storey extensions to south/west, north/east and north/west to provide 62 no. bedrooms together with the renovation of the health club including swimming pools, banqueting area, reception and staff rooms with associated landscaping and including demolition of sports hall for Mountain Capital Ltd at Redwood Lodge Hotel & Country Club.

g)      APPLICATION 08/P/1073/LB - Replacement of all windows, repairs to bay roof on west elevation, repairs to stonework and cleaning of stonework for Mr R Lewis, Belmont House, Belmont Hill, Wraxall.

Report - The description of the application needs amending to :- Replacement of 1 no. window (in ground floor scullery) and repair to remaining windows.

Cllrs. visited the site and were shown 1 no. replacement window and observed the repaired other windows. Note: This is a paper exercise for work completed in 2006/7.

 

RECOMMENDATION - Approve.

 

 

 

 

 

h)      APPLICATION 08/P/1089/F - Retrospective application for the erection of a floodlight for Tout Ltd, Wraxall Service Station, Bristol Road, Wraxall.

Cllrs. visited the house opposite to the Service Station - they had no complaints.

The house to the North is unoccupied.

The house to the South - couldn't get an answer.

If any residents affected it would be the two to the South. However, as the light has been in existence for 8 years it is assumed that this application is a formality to clear up the situation. Cllrs. tried to view the light from the vicinity of the 2 southerly houses and felt that they were not able to see the light which is in the rear of the Service Station site.

 

RECOMMENDATION - Approve.

 

i)         APPLICATION 08/P/1140/F – Erection of a single storey rear extension for Mr B Swift at 33, Vowles Close, Wraxall.

 

RECOMMENDATION – No objection – Voting 6 for – 3 against (1 abstention)

 

j)         APPLICATION 08/P/1162/F – Alterations and extensions to provide granny annexe and carport following the demolition of existing double garage and single storey side extension.  Creation of new vehicular access for Mr A Mikkelson, Tree Tops, Tower House Lane, Wraxall.

 

RECOMMENDATION – Majority in favour of Support with the conditions that:-

1.       Delivery vehicles do not exceed one and a half tons (Lane is single track and

liable to subsidence on East side)

2.   Delivery vehicles do not block the lane and

3    The existing garage is demolished prior to building work commencing to   

allow access to the site.

 

k)       APPLICATION 08/P/1175/F – Erection of a two storey rear extension (alterations to front elevation approved 06/P/2516/F) for Mr & Mrs Gerardi, Failand View, Horse Race Lane, Failand.

 

RECOMMENDATION – From memory Councillors think that there has been a previous extension of say 35 – 40%.  Could this proposed extension take the amount of extension over the prescribed percentage? 

The property was originally owned by a local farmer.  Can NSC please investigate if there is an agricultural tie still on the property?

The recommendation is 9 to support the proposal (1 abstention) once the above has been investigated.

 

l)        PRE DECISION AMENDMENT TO 08/P/0629/F – Use of land for up to 40 days in each calendar year for the purposes of agricultural show, game fair and associated activities, with access from Clevedon Road and Station Road – North Somerset Showground, Station Road, Flax Bourton.

AMENDMENT TO SITE DESCRIPTION AND CLARIFICATION OF PROPOSALS

 

RECOMMENDATION – The new information has not changed Councillor’s opinion of the application, which remain:- Access acceptable with annual re-assessment of the 40 day operation.

 

m)     APPEAL SITE VISIT re. GLB’s land near Cricket Ground, Failand.

Cllr Sage gave a report on the site visit.

 

n)      CAC SITE VISIT re. 08/P/0442/F – Laundry Cottages, Belmont Estate

Both D/Cllr. Roberts & Cllr. Ambrose spoke, at the site visit, in favour of the garages.

       

o)      APPEAL re. Land at 3 Ferney Row, Green Lane, Failand.

This appeal has been withdrawn and no further action will be taken.

 

p)      Clerk reported on decisions made by NSC on planning applications previously considered by this Parish Council

 

EXTRAS

1.       APPLICATION 08/P/1228/F INFORMATION ONLY - NAILSEA APPLICATION Erection of employment buildings for B1 or B8 use (Light industrial – wholesale warehouse) for Richard Payne, Kitto Developments Ltd re. Employment Site, Southfield Road Ind. Estate, Nailsea.

 

Nailsea have asked for expert opinion on traffic management and unsatisfactory access.

 

2.       CLIFTON LODGE, FLAX BOURTON ROAD, FAILAND.

Cllrs. advised that ‘Enforcement Notices have been served upon the owner of the above property in respect of a change in use of land and storage of vehicles’.

 

3.       PHONE BOX REMOVALS

 

LETTER RECEIVED FROM ANNA HAYES NSC asking for comments regarding the proposed removal of telephone boxes.  Reply as follows:-

BOX AT CHURCH IN LOWER FAILAND 01275 373842 – No objection to the removal.

BOX NEAR OLD POST OFFICE, CLEVEDON ROAD, FAILAND 01275 392581 – This should be kept in service but at present the inside has been removed and needs replacing.

BOX AT BRISTOL ROAD, WRAXALL 01275 852141 – Strong objection to the removal of this box.

 

 

61                 HIGHWAYS & TRANSPORTATION

 

a)       SPEED LIMIT – BEGGAR BUSH LANE    (Letter from Howard asks us to discuss and put pressure on Highways)

 

b)      TEMPORARY PROHIBITION OF USE BY VEHICLES – LODGE LANE – 9 June for 2 weeks.

 

c)       TEMPORARY PROHIBITION OF USE BY VEHICLES – PORTBURY LANE – 23 June, 2 days.

Cllr. Smith asked if this could be changed as the two days specified are Tyntesfield ‘Open Days’ and Portbury Lane is the route directed from the Motorway.  Cllr. Ambrose suggested that Ruth Gofton Property Manager of Tyntesfield should speak to NSC direct.

a)       E-MAIL ‘LAUNCH OF COUNTDOWN 2010 FUND AND NERC S41 LIST PUBLISHED.

This is a great opportunity to get a Grant but refers to Voluntary Organisations.

Cllr. Horry has resigned, Cllr. James Tonkin appointed  (He came 3rd in the original ballot) All except NTC & W&F asked to nominate for the 3rd representative.

 

64                 MEETINGS

 

a)      FEEDBACK FROM APM 22 APRIL 2008. Cllr. Ambrose felt that the meeting was too long and the style degenerated as the speaker turned up late and then had to ‘set up’.

Public seem to prefer some form of forum for questions.  Some things were more interesting than others and needed more time.  Consider prior to next APM.

 

b)      AFFORDABLE HOUSING OPEN DAY 21 MAY 2008 – No one attended.

 

c)       TOWN & PARISH DEVELOPMENT CONTROL WORKSHOP 5 TH JUNE.  Cllr. Ambrose will forward a copy of the handout from the meeting.

 

d)      COUNCILLORS WORKSHOP 11 JUNE – ROLES & RESPONSIBILITIES

West Harptree Memorial Hall. 6.45 – 9 pm.  Booking has been confirmed for Cllrs. Delmas, Law, Thompson & Smith. Agendas & map handed out.

 

e)       COMMUNITY ACTION – SUSTAINABLE COMMUNITIES CONFERENCE – 26 June 9.30 – 3.30.
