FAILAND PARISH COUNCIL MEETING HELD 10 FEBRUARY 2009 IN
PRESENT: Cllrs. Ambrose (Chairman), King (Vice Chairman), Mrs Shaw, Sheppard,
Thompson, Smith, Sage, Law, Delmas & Mrs Moon.
IN ATTENDANCE: District Cllrs. Cook & Roberts, Liaison Officer Sally Varley & Clerk.

149 MINUTES The minutes for the meeting held 13 January 2009 were agreed and signed.
150 CRIME FIGURES: PC Clarke was unable to attend but had sent the crime figures.
8 between last meeting to date. (1 Criminal Damage to vehicle @ Grove, 4 Thefts of fuel from Budgens, 1 Theft of lawnmowers @ Clevedon Road, 1 Theft of Oil from Wraxall School, 1 Assault @ Grove (Domestic)
Dr Amos said that there had been a serious case of sheep worrying but, as police from Clevedon attended, it was not included in this figure.

Clerk to write to Sustrans & NSC asking that they inform us of their intentions.
151 TYNTESFIELD:
Ruth Gofton reported that there were lots of building projects on going –
Home Farm, Main House – scaffolding, Stable Yard.
Some snow damage to trees and the marquee. There are lots coming down from the Trust to see what and how things are going.
The fungal audit has been undertaken ~ there are 700 types within the Estate.
Main House will re-open on April 4.

Despite Quartet stating over the telephone that ‘Express Program’ was for Parish
Plans and that we would be eligible, the application has been rejected because they feel that Parish Plan is ‘under our umbrella’ and we are a Statutory Organisation.
d) COMMUNITIES IN CONTROL: REAL PEOPLE, REAL POWER: CODE OF RECOMMENDED PRACTICE ON LOCAL AUTHORITY PUBLICITY – A CONSULTATION ~ Nothing further.

a) APPLICATION 08/P/2634/LB – Repairs to roofs, roof features, glazing to roofs inc. replacement skylights and access hatches/doors, masonry, and rainwater goods using matching materials. Internal works to upgrade the electrical and mechanical services to include new light fittings and radiators for National Trust at Tyntesfield.
RECOMMENDATION - APPROVE.
b) APPLICATION 09/P/0010/F – Retrospective planning application consolidating the use of part of Moat House Farm as a zoo tourism attraction. To include the use of existing buildings for the housing of animals kept in association with the tourism attraction, the use of specific buildings for accommodating animals, shop, café, education suite, offices, w/c’s, indoor play arena, ticket office, first aid station, Noah’s Ark and food & farming exhibitions. To use the land for the keeping of large zoological animals, establishment of a maze, outdoor play and picnic areas and car and coach parking areas for Mr & Mrs A Bush, Moat House Farm, Clevedon Road, Wraxall.
Four Cllrs. considered the application which has raised a number of questions:-
¨ Why has it taken so long for NSC to discover the omission?
¨ Does it have a legal impact on more recent applications?
¨ Which legal hierarchy has precedence, the Zoo Licence or the Planning Application Approval?
¨ Do issues surrounding the existing and proposed PROW need to be resolved before any approval is granted?
Councillors, whilst considering this unusual situation, concluded that by virtue of earlier, and quite specific, applications being approved and the granting and subsequent renewal of a zoo licence that tacit approval already exists and therefore we have no objection in respect of this application subject to the satisfactory answers to the earlier questions.
The Parish Council has not yet considered the applications for the additional car parking and the tiger enclosure, because it is considered that the footpath issue must be resolved first and we should not be supporting this most recent planning application.
c) APPLICATION 09/P/0028/LB – Introduction of 9 no. new internal fire doors and upgrading of 34 no. existing internal doors for The National Trust at Tyntesfield.

RECOMMENDATION ~ Planning history must be checked. If that is acceptable in terms of ‘within the overall allowed size of development’ then we would support.

a) RECYCLING BINS IN WRAXALL ~ No suggestions for replacement site.
b) FOREST OF AVON ‘WOODWISE’ PROJECT – This is within Ashton Hill Woods, not within our parish. Forest of Avon are to teach up to 24 young people, from Florence Brown Special School in South Bristol, new skills in green woodworking and woodland management. They will get a chance to build a timber frame shelter with the support of professional timber framers.
